By way of the present first petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the grant of regular bail as a prisoner in case FIR No. 276 dated 17.11.2021, registered under Sections 379B(2), 323, 34 IPC (corresponding provisions under BNS i.e. Sections 304, 115(2), 3(5)), at Police Station Maqboolpura, Amritsar. 2.

It is contended by the petitioner that he has been falsely implicated in the present case. Earlier, he was on bail, however, during the trial he was arrested in some other case, due to which he could not appear before the Court and could not inform his counsel to take appropriate steps. As a result thereof, his bail was cancelled and he was declared a proclaimed offender. Thereafter, he was arrested on May 2025 and since then he is in custody. Notice of this bail application was issued to the State, which has opposed the same on the ground that since the petitioner had earlier been declared a proclaimed offender, there is every likelihood of his absconding ANU 2026.03.18 18:09 I am the author of this document Chandigarh

CRM-M-13804-2026 again if released on bail. However, it has been fairly submitted by the State that the co-accused in the present case has already been acquitted. 3.

The petitioner is in custody for the last about 10 months. The co-accused, who was the main accused in the present case, already stands acquitted. The role attributed to the present petitioner is primarily on the basis of disclosure statement of the main accused. The petitioner has undertaken to appear before the trial Court on each and every date of hearing and to abide by all the conditions imposed by the Court. The trial is likely to take time for its conclusion. In these circumstances, continued incarceration of the petitioner would serve no useful purpose. 4.

Accordingly, the petitioner is ordered to be released on regular bail subject to furnishing adequate bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. 5.
