Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Lakhwinder Singh - in a case arising from FIR No.56 dated 24.06.2019 registered under Section 376 IPC (Section 450 IPC, Section 6 of the POCSO Act added and Sections 4 of the POCSO Act deleted later on) at Police Station Chabhal, District Tarn Taran.
According to the prosecution, in the night of 21.06.2019 petitioner was caught red-handed committing rape upon minor daughter of the complainant.
Learned counsel inter alia contends that complainant and her daughter (prosecutrix) have turned hostile. Petitioner is in custody since 26.06.2019. Conclusion of trial may take a sufficient long time. No useful RAVINDER SINGH 2020.06.25 15:55 I attest to the accuracy and integrity of this document
-2CRM-M-14478 of 2020 purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, petition is allowed. Consequently, petitioner Lakhwinder Singh - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
