This is an application for impleading the legal representatives of the respondent - Dariya Singh - who is stated to have died. 2.

For the reasons stated in the application, the same is allowed subject to all just exceptions and the legal representatives of the respondent - Dariya Singh - mentioned in para No.2 of the application are impleaded as a party. Vakalatnama signed by the legal representatives of the respondent - Dariya Singh - is already appended with the present application. Amended memo of parties is taken on record.

Learned counsel for the appellant states that he has no instructions in the matter.

Vide order dated 08.01.2024 notice was issued to the appellant. As per the office report, the sole appellant is stated to have died. No one has come forward to get themselves impleaded as legal representatives of the appellant nor any counsel has put in appearance on their behalf. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
