The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.57 dated 21.5.2016 registered for the offence under Section 306 read with Section 34 IPC at Police Station Machhiwara, Police District Khanna, District Ludhiana. I have heard learned counsel for the petitioner and have gone through the record.
The FIR in the present case has been registered on the statement of Harjit Kaur, who stated that her marriage was solemnized with Gurdip Singh and they have two children. On 17.5.2016, their commission agents Mukhtiar Singh and Gurmeet Singh forcibly cultivated their land and took possession of the same. They even made an attempt to take possession of half of their house. There is also allegation that commission agents had purchased the land from her husband Gurdip Singh, but they did not show Harpal Singh Parmar 2016.08.17 17:33 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-28171 of 2016 [2] any sale deed. She came to know about the sale deed on 17.5.2016. It is also the allegation that no sale consideration was received by them qua that sale deed. The husband of the complainant, namely, Gurdip Singh took some poisonous substance and committed suicide. Keeping in view the nature and gravity of the offence and the fact that the petitioner is named in the FIR and specific role has been attributed to him, he is required for custodial interrogation, therefore, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
