The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.87 dated 10.6.2016 registered for the offence under Section 365 IPC at Police Station Nangal, District Rupnagar.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR in the present case has been got registered by Simro Devi by stating that the present petitioner is doing the job of truck driver. He took Madan Lal-husband of the complainant by fixing daily as helper. After three days, Sadiq Mohammed called her over phone and inquired as to whether Madan Lal has reached home or not. As per the allegations, Madan Lal has not been recovered so far. It is only the present petitioner, who can explain as to what happened to Madan Lal. Cr. Misc. No.M-28176 of 2016 [2] the order dated 2.8.2016 passed by the learned Sessions Judge, Ropar, it has been discussed that the versions of the petitioner are contradictory and even the statement of the owner of the Transporter was also recorded by the Police, who stated that he had not seen Madan Lal in the company of the petitioner right from the day one.

Keeping in view the facts and circumstances of the present case, I find that the petitioner is required for custodial interrogation. In the facts and circumstances of this case, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
