(ORAL) In the present writ petition, the claim which is being raised by the petitioner is that he has spent approximately `9,60,000/- on the medical treatment, for which he is entitled for the reimbursement. Counsel for the petitioner states that the said amount was incurred by the petitioner in the year 2015 and even after an expiry of more than 21⁄2 years, he has not been reimbursed the said amount. Counsel for the petitioner further states that petitioner had served the respondents with a legal notice dated 13.06.2018 (Annexure P-6).
Further, after the receipt of the said legal notice, a direction was given to the Executive Officer of the Improvement Trust, Batala, to decide the same by passing the speaking order. Even though the said direction was issued in July, 2018, but till date, no order deciding the claim of the petitioner has been passed by respondents No.2 and 3. NARESH KUMAR 2019.04.
CWP-8590-2019 -2Counsel for the petitioner further states that the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondents No.2 to 3 to decide the legal notice dated 13.06.2018 (Annexure P-6) by passing a speaking order.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondents No.2 and 3 are directed to decide the legal notice dated 13.06.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
