Rajan Gupta, J (Oral) Petitioners seek bail in a complaint case titled Hemlata Vs. Bachuchu Singh and others wherein they have been summoned to face trial for offences under Sections 498-A, 406, 376-D, 307, 328, 120-B, 148, 149, 506, 34 IPC.
Learned counsel for the petitioners submits that on the basis of preliminary evidence, petitioners have been summoned to face trial. Pursuant to same, they are in custody since 12.6.2015. As the trial may take long time to conclude, petitioners deserve to be enlarged on bail. Prayer has been opposed by counsel for the complainant. However, keeping in view the fact that petitioners are accused pursuant to summoning order and they have been incarcerated for almost two months, no useful purpose would be served by detaining them any longer. As the trial may take long time to conclude, they be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Palwal.
