Learned counsel for the State has opposed the present petition, on the ground that the petitioner has been declared a Proclaimed Offender in the present FIR, vide order dated 29.07.2022 (Annexure P-1).

I have considered the aforesaid contentions.

There are allegations against the petitioner that he has sexually assaulted the prosecutrix who is a child-victim aged about 15 years. The co-accused of the petitioner who has been acquitted, as per the judgment dated 08.12.2023 (Annexure P-2) was given the benefit of doubt and there were no specific allegations of sexually abusing the prosecutrix by the co-accused of the petitioner. He was only alleged to have been standing as a guard at the time of the alleged commission of the act of sexual abuse by the petitioner. As such, the petitioner is not entitled to any benefit on account of the said judgment of acquittal passed by the trial Court. The petitioner has misused the process of law by not appearing despite receiving of proclamation notice and ultimately, he has been declared a Proclaimed Offender. There are serious allegations against the petitioner for sexually abusing the victim.

Keeping in view the age of the victim and other circumstances on record, no ground for anticipatory bail is made out. 8.
Consequently, the present petition stands dismissed. 9.
