M.M.S. BEDI, J. (ORAL) Petitioner as a member of an unlawful assembly had allegedly attacked Kanta and her husband while they were returning from their fields.

So far as the petitioner is concerned, he has not been attributed any specific injury on the person of Sajjan Singh. The bail application of the petitioner has been dismissed on the ground that the injured is admitted in hospital and the other co-accused are absconding. The petitioner is stated to be an old man of 70 years of age.

No specific injury having been attributed to him and he being in custody w.e.f. 28.7.2015, can be granted the concession of bail.

The petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate, Jhajjar. (M.M.S.BEDI) JUDGE August 21, 2015.
