(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for setting aside the impugned order dated 22.05.2017 (Annexure P-1) passed by Judicial Magistrate Ist Class, Hoshiarpur, in a case arising from FIR No.20 dated 06.03.2015 under Sections 304A, 279 and 427 IPC registered at Police Station Hariana, whereby cross-examination of PW2 to PW4 was closed by treating the same as nil.
Heard.
Though there is no merit in the instant petition, however, in the interest of justice, the trial Court is directed to give an effective opportunity to the petitioner to cross-examine PW2 to PW4, namely, Rajbir Singh, Damanpreet Singh and Parmod Kumar, respectively, subject to costs of ` 10,000/- to be deposited by the petitioner with the trial Court towards legal aid fund.
