This is a petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in FIR No.197 dated 04.05.2019 for the offences punishable under Sections 379-A and 411 of the Indian Penal Code, 1860 registered at Police Station Pundri, District Kaithal. Learned counsel for the petitioner has submitted that the petitioner was riding the motorcycle and the co-accused, who was the pillion rider, had snatched the mobile phone of the complainant. On 25.6.2020 the petitioner was granted interim bail. Today the learned State counsel, on instructions from ASI Satpal, has stated that the petitioner was riding the motor-cycle and the mobile was snatched by the pillion-rider who is the co-accused. He has further stated that no recovery is to be made from the petitioner-herein.

In view of the above, the interim bail granted to the petitioner vide order dated 25.06.2020 is made absolute. The petitioner is ordered to be released on regular bail on his furnishing fresh bail and surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
