(Oral) Present petition has been preferred against the judgment dated 12.05.2005 passed by learned Additional Sessions Judge, Bhiwani whereby judgment of conviction and order of sentence dated 15.01.2002 passed by learned Sub Divisional Judicial Magistrate, Charkhi Dadri in case stemming from FIR No.172 dated 16.10.1996 registered under Section 406 IPC at Police Station City Dadri, have been upheld.

2. Learned counsel for the petitioner, at the very outset, submits that during the pendency of present petition, petitioner-Bhagirath has passed away.
