(ORAL) Learned counsel for the petitioners states that the department was of the view that the benefit of ACP cannot be granted to the junior engineer in view of the Govt. of Punjab Personnel Department Instructions dated 03.11.2006.
Learned counsel for the petitioners states that this Court while deciding CWP No.16446 of 2010 on 20.05.2013, held that the JEs are also entitled for the benefit of the instructions dated 03.11.2006. Further, the Letters Patent Appeal filed against the said order has already been dismissed by the Division Bench on 19.12.2014 (Annexure P-6). Learned counsel for the petitioners states that despite the fact that the relief has been extended to the similarly situated employees, the same has not been extended to the petitioners. CWP-8581-2019 -2Learned counsel for the petitioners further states that for the relief which has been claimed in the present writ petition, the petitioners has served the respondents with a legal notice dated 24.01.2019 (Annexure P-8), which is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the legal notice dated 24.01.2019 (Annexure P-8) by passing an appropriate speaking order. Without commenting upon the merits of the case or about the entitlement of the petitioners for the relief which has been claimed by them in the legal notice dated 24.01.2019 (Annexure P-8), the present writ petition is disposed of with a direction to the respondents to decide the legal notice dated 24.01.2019 (Annexure P-8) within a period of three months from the receipt of certified copy of this order.
