R.P. NAGRATH, J. (ORAL) Prayer in the instant petition filed under Section 482 Cr.P.C. is for quashing of Criminal Complaint No. 746-12001/05 dated 02.06.2001/12.08.2005 (Annexure P-1) filed under Section 500 of the Indian Penal Code titled as "Harbans Lal Vs. Ashok Aggarwal and others" and all the subsequent proceedings arising therefrom including the summoning order dated 26.11.2001 (Annexure P-2). There is categorical assertion in paragraph 16 of the petition that the petitioner has not filed any such or similar petition either in this Court or the Hon'ble Supreme Court of India.

Earlier, CRM-M-23108-2010, for the similar relief in the same complaint was filed by the petitioner which was dismissed for want of prosecution vide order dated 06.02.2015 passed by this Court. In view of the above, learned counsel for the petitioner RISHU KATARIA 2015.08.20 16:41 I attest to the accuracy and authenticity of this document

CRM-M-27409-2015 -2withdraws the instant petition, with liberty to take appropriate recourse for restoration of the earlier petition but since there is concealment of facts while filing the instant petition, the same deserves to be dismissed by imposing costs.

So without prejudice to the right of petitioner to file restoration application, the instant petition is dismissed with ` 25,000/- as costs to be deposited with State Legal Services Authority, Haryana within one month from today.
