-.- JAISHREE THAKUR J. (ORAL) On receipt of application/complaint received from Charanjit Singh son of Joginder Singh, resident of village Bhutti Wala, Police Station Makhu, Tehsil Zira, District Ferozepur with an allegation that his mother has been forcibly taken away by the police officials of Police Station Ghall Khurd, the same has been entertained as writ of habeas corpus under Article 226 of the Constitution of India.
Notice of the said petition was issued to the State of Punjab and a reply was sought in the said matter.
Pursuant to the said notice, a status report has been filed by way of affidavit of Rajwant Kaur, Sub Inspector No.21/JPCT, SHO, Ghal Khurd, District Ferozepur stating that a complaint was received against brother of Charanjit Singh on the basis of which an FIR No.37 dated 11.05.2020 under Sections 307, 323, 506, 427, 454, 380, 148, 149 IPC and 25/27 of the Arms Act has been registered. It has further been stated in the status report that neither the mother of the petitioner is required by the police for interrogation in any cae nor she was ever apprehended by the police as alleged in the instant petition.
CRWP No.3575 of 2020 -2I have heard learned counsel for the State and have also perused the status report as filed. In view of the fact that mother of the petitioner was not apprehended by the police at any point of time as alleged in the instant petition, no further orders are called for in the instant petition. Disposed of accordingly.
