The present appeal was admitted on 03.03.1998. Respondents have never put in appearance in the present case. As per the service report, respondents No.1 to 4 have since expired and respondent No.5 did not appear despite service. Learned counsel for the appellant was granted opportunities to implead the legal representatives of deceased respondents No.1 to 4. However, despite last opportunity granted on 28.11.2024, no such application has been filed to implead the legal representatives of the said respondents. Today, despite the matter being called twice since morning, none has put in appearance on behalf of the appellant. 2.
In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution. 3.
Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
