Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in criminal complaint No.314 dated 02.11.2006/22.09.2014 under Sections 166, 167, 193, 468, 471 and 120-B IPC pending in the Court of learned Judicial Magistrate Ist Class, Anandpur Sahib, District Rupnagar, in which petitioner has been summoned for offence under Section 468 IPC. Notice of motion was issued and learned State counsel as well as respondent No.2- in person appeared and contested the petition.

It is a complaint case. The petitioner is not required for any investigation or interrogation purposes nor anything is to be recovered from him. He is only to appear before the trial Court and to face the trial. As per order dated 19.08.2015, the petitioner has appeared before learned SDJM, Anandpur Sahib and has been released on interim bail.
The disposal of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 19.08.2015 is made absolute.
