Vide order dated 02.12.2023 fresh notice was issued to the appellant as well as respondent No.1. As per office report, both the appellant and respondent No.1 have since died. None has come forward on behalf of their legal representatives for being impleaded as a party in the present appeal.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
