Petitioner seeks grant of regular bail under Section 439 Cr.P.C. in case bearing FIR No.32 dated 30.01.2021 under Sections 379-B, 452, 201 IPC registered at Police Station Gandhi Nagar, District Yamuna Nagar, Haryana. Vide order dated 19.05.2021, interim bail was granted to the petitioner on the premise that the matter has been compromised between the parties on the strength of Annexure P-2 i.e. affidavit executed by Nitin Kapoor @ Bantycomplainant. Learned State counsel was directed to verify the aforesaid factual position.

CRM-M No. 18193 of 2021 -2Today, learned State counsel on instructions from ASI Rishi Pal submits that the parties have amicably resolved their differences.
In view of statement made by learned State counsel and also in view of compromise dated 05.02.2021, I deem it appropriate to grant regular bail to the petitioner. Keeping in view the situation arising out of pandemic COVID-19 and without meaning anything on the merits of the case, petitioner is directed to be released on regular bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of trial Court/concerned Duty Magistrate. Nothing expressed hereinabove would be construed to be an opinion on the merits of the case.
