The present appeal pertains to the year 1997. Vide order dated 05.12.2023 notices were issued to the appellant and respondent No.1. As per the service report, sole appellant as well as respondent No.1 refused to accept the notice, however, affixation has been made. Accordingly, they are deemed to have been served. No one has put in appearance on behalf of the appellant.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
