PANKAJ JAIN, J. (ORAL) CM-12590-CII-2023 This is an application filed under Section 5 of Limitation Act seeking condonation of delay of 267 days in filing the instant appeal. For the reasons recorded in the application, this Court is satisfied that the applicants/appellants have made out a sufficient cause for condonation of delay.

Consequently, the present application is allowed. The delay of 267 days in filing the instant appeal is hereby condoned. FAO No.3815 of 2023 (O&M) The present appeal arises out of a claim petition filed under Section 166 of the Motor Vehicles Act, 1988.

On the asking of the Court, Mr. Satpal Dhamija, Advocate accepts notice on behalf of respondent No.3.

The appellants sought compensation on account of death of their son Nitesh Kalra, who died in a road side accident, dated 18.08.2018 at a young age of 18 years. The Tribunal awarded compensation of Rs.16,22,000/-.

The appellants are impugning the award before this Court seeking enhancement of compensation awarded by the Tribunal. 5.

After hearing counsel for the parties and after carefully perusing the records of the case, this Court finds that the only modification that is required to be made in the impugned award is that each of the claimants shall be entitled for an amount of Rs.48,400/- on account of loss of consortium. An amount of Rs.15,000/- awarded under the head of loss of estate and Rs.15,000/- awarded towards funeral expenses, are enhanced to Rs.18,000/- each.

Needless to say, anything paid to the appellants/claimants shall be adjusted and set off.

With the aforesaid modification in the impugned award, the appeal is disposed off.
