Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in FIR No.121, dated 21.07.2015, under Sections 304, 170 and 506 of the Indian Penal Code, 1860 (for short 'IPC'), registered at Police Station Morinda, District Rupnagar. Learned counsel for the petitioner has submitted that due to typographical error in the head note of the petition "under Section '340' IPC has been mentioned instead of Section '304' IPC. Let necessary correction be made in the head note of the petition as FIR has been registered qua offence punishable under Section 304, 170 and 506 IPC. Prosecution story, in brief, is that on 11.06.2015, husband of the complainant had received phone call at about
CRM-M-27555-2015(O&M) [2] **** 10:30 P.M. The person who had called the husband of the complainant had extended threats to him. Due to this reason, husband of the complainant got frightened and fell on the floor. When the husband of the complainant was taken to a clinic for treatment, he was declared dead.
Learned counsel for the petitioner has submitted that petitioner is in custody since 06.08.2015. There was no previous enmity between the parties. Petitioner has been falsely involved in this case.
Learned State counsel, on the other hand, has opposed the petition.
Keeping in view the submissions made by learned counsel for the petitioner, it would be just and expedient to order the release of the petitioner on bail. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Rupnagar.
