This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.0747 dated 1.8.2018 for the offences under Sections 398 and 401 and Section 25 of the Arms act, 1959 at Police Station Hisar Sadar, District Hisar.

Notice of motion to Advocate General, Haryana. Mr. Navdeep Singh, learned Assistant Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the prosecution version, the FIR has been registered on HARPAL SINGH PARMAR 2019.04.08 10:32 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-14330 of 2019 [2] the basis of a secret information that three young boys carrying weapons in Baleno car, which was in accidental condition and without number plate, under over bridge outer bye-pass to Rajgarh road and are trying to loot passersby. If immediately raid is conducted, then all the three boys along with car and weapons can be apprehended. A raid was conducted and the present petitioner along with co-accused were apprehended and a country made revolver has been recovered from him.

The petitioner has been in judicial custody since 1.8.2018. He is not required for any investigation or interrogation purposes as he is in judicial custody. The trial of the case is likely to take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
