**** DEEPAK GUPTA, J. (ORAL) On 12.12.2023, Mr. Akshay Jain, Advocate appearing for the appellants had informed that he was unable to establish contact with his clients. As such, noce was issued to the appellants. 2.

As reported by the registry, noce issued to appellant No.1 received back duly served; noce issued to appellant No.2 received back with the report that he has since expired. They were son and mother. 3.

Though respondents were earlier ex parte but today Mr. Himanshu Sea, Advocate has put in appearance on behalf of respondent Nos.1 and 2.

It is informed by learned counsel that it was a dispute among the family members, inasmuch as appellant No.1 and respondent Nos.1 and NEETIKA TUTEJA 2025.10.29 17:43 I attest to the accuracy and integrity of this document

RSA-630-1997 (O&M) 2 are the sons of Rameshwar; whereas appellant No.2 is the wife of Rameshwar. Respondent No.3 is the grandson of appellant No.2. 5.

Learned counsel informs that ma5er has since been compromised amongst the pares on 27.03.2024 whereby the surviving appellant Ram Sarup had undertaken to withdraw the present appeal bearing No.RSA/630/1997. Learned counsel has also placed on record copy of that compromise as well as death cerficate of Satpal (respondent No.2). 6.

Considering the circumstances that one of the appellant has died and the other appellant has not appeared before the Court, despite service and also considering the compromise which has been placed on record, the present appeal is hereby disposed of for want of prosecuon and also on account of compromise.
