The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.11 dated 7.6.2018 registered for the offences under Sections 7 and 13(2) of Prevention of Corruption Act, 1988 at Police Station Vigilance Bureau, Bathinda, District Bathinda. Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Amarpreet Singh, Advocate appeared for Mr. Binderjit Singh, learned Advocate for the complainant and contested this petition.
I have heard learned counsel for the parties as well as learned State and have gone through the record.
As per the FIR, the allegation against the present petitioner is HARPAL SINGH PARMAR 2018.11.14 16:35 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-28589 of 2018 [2] regarding demand of bribe and it has been stated that the conversation has been recorded. The petitioner has already joined the investigation. Learned State counsel has informed that voice sample of the petitioner has already been taken. He is not required for custodial interrogation. No useful purpose will be served by sending the petitioner to custody.
Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 10.8.2018 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. November 13, 2018.
