!"# $ Allegations against the petitioner Sajjad @ Amir in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.23 dated 15.01.2015 registered at Police Station Sadar Karnal under Sections 341/342/392/397 IPC and Section 25/54/59 of the Arms Act, are that on 15.01.2015 he along with his co9accused/non9 applicant armed with a pistol has waylaid a motorcyclist and robbed him of his cash worth 600, mobile phone along with ATM card. Contentions of learned counsel for the petitioner that the petitioner is in custody since 16.02.2015 and that the trial is not likely to conclude in the near future and the petitioner is not facing any other similar case, have not been controverted by learned State counsel. In view of the submissions made and the fact that culpability, if any, shall be determined at the time of trial together with the fact that the trial will take a long time to conclude, this Court without going into the merits of the case, is of the opinion that no useful purpose will be served by keeping the petitioner behind bars in the present case. Accordingly, he is ordered to be released on regular bail to the satisfaction of trial Court.
