ALKA SARIN, J. (ORAL) 1.

The present appeal pertains to the year 1997. Vide order dated 08.12.2023 notices were issued to the parties. As per the service report, the sole appellant remains unserved as he is stated to be residing abroad. This is the only address which was given in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court. Respondents No.1 and 2 stand duly served. Respondent No.3 has died. No one has put in appearance on behalf of the appellant. It appears that the appellant is not interested to pursue the present appeal. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
