On the previous date of hearing i.e. 04.12.2023, none had put in appearance on behalf of the appellant and notice was issued to the sole appellant. As per office report the appellant remains unserved with the report that Abohar Co-operative Spinning Mills Ltd. has been closed since many years and further the Chief Executive Mr. M.C. Tiwari is not residing at the given address. This is the only address which was given in the memo of parties.

Today no one has put in appearance on behalf of the appellant. This Court is left with no option but to dismiss the present appeal for nonprosecution. 3.
