This is an application on behalf of the applicant-respondent for preponing the date of hearing in the main case from 07.08.2024 to an early date.

Learned counsel for the non-applicant/petitioner states that he has no objection if the present application is allowed and the date of hearing is preponed.

In view of the above and for the reasons stated in the application, the same is allowed. With the consent of the learned counsel for the parties, the main case is taken on Board today itself. CR-2217-2023 4.

Pursuant to the order dated 21.05.2024, the parties are present in Court today.

Learned counsel for the petitioner would contend that the petitioner would hand over vacant possession of the suit property on or before 01.08.2024 and that within the next 15 days from today the petitioner would clear all arrears of rent and would continue to pay the rent by the 7th of every month till he hands over peaceful vacant possession to the respondent.

Learned counsel for the respondent states that he has no objection.

I have heard the learned counsel for the parties. 8.

In the present case the statements of the parties have also been separately recorded to the extent that the petitioner would hand over peaceful vacant possession of the suit property on or before 01.08.2024. Meanwhile, all arrears of rent shall be paid by the petitioner within 15 days from today and future rent shall be paid by the 7th of every month till the petitioner hands over peaceful vacant possession to the respondent. The petitioner shall also furnish an undertaking to this effect before the concerned Rent Controller.

In view of the above, the present revision petition stands disposed off in the above terms. Pending applications, if any, also stand disposed off.
