(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 33 dated 09.04.2015, registered at Police Station Bullowal, District Hoshiarpur, who has been booked for having committed the offence punishable under Section 376 IPC. Learned counsel for the petitioner at the very outset has submitted that the prosecutrix was 42 years and was married about 20/21 years back and having one son aged 17 years. The petitioner is also 61 years old.

It is a case of version and cross version, as the petitioner has also registered one DDR No. 21 dated 09.05.2015 against the complainant and others, who trespassed into the house of the petitioner and caused him injuries.

Crl. Misc. No. M-28533 of 2016 -2Officer has informed the Court that after recording the preliminary evidence, the case is fixed for defence evidence on 12.10.2016. Petitioner is in custody since 25.05.2015.

Keeping in view the age of the petitioner and the prosecutrix and the fact that it is a case of version and cross version, this Court feels that there is no need to detain the petitioner any longer. Accordingly, the present petition is allowed.
