*** HARSIMRAN SINGH SETHI, J.(ORAL) The petitioner is seeking anticipatory bail in FIR No. 47 dated 02.04.2020 under Sections 420, and 120-B IPC registered at Police Station Sadar Patti, District Tarn Taran.

Learned counsel for the petitioner contends that the petitioner has joined investigation in terms of order passed by this Court dated 19.08.2020. Order dated 19.08.2020 is as under:- "Briefly, FIR No. 47 dated 02.04.2020 under Sections 420 and 120-B IPC has been registered against Tarsem Singh (petitioner), his brother Paramjit Singh and Jaswinder Singh on the allegation that they had extracted a sum of Rs.2,25,000/- from Panjab Singh (complainant) on the pretext of sending his younger brother abroad. On 12.06.2020, Panjab Singh was also arrayed as respondent No.2 and notice

was issued to him. However, order dated 15.07.2020 indicates that none had appeared on behalf of respondent No.2 despite service.

It has been stated by learned counsel for the petitioner that coaccused Paramjit Singh has been granted bail by the Court of Sessions. Furthermore, there is no document evident of any transaction between the parties. The petitioner is an ex army man and has been falsely implicated in this case. Adjourned to 17.10.2020.

In the meanwhile, the petitioner is directed to join investigation and in the event of his arrest, he shall be released on interim bail to the satisfaction of Investigating Officer/Arresting Officer subject to the conditions as envisaged under Section 438 (2) of Code of Criminal Procedure. "

Learned State counsel, who has also joined the proceedings through video conference, on instructions from ASI Lakhwinder Singh, states that in terms of the order of this Court reproduced before, the petitioner has joined the investigation and no further interrogation is required at this stage.

Learned counsel for the petitioner undertakes that petitioner will join investigation and also cooperate with the investigating agency in case he is required for the same in future as well. In view of the above, the order dated 19.08.2020 granting interim bail to the petitioner is made absolute. However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

In case at any given point of time hereinafter, it is felt by the investigating agency that petitioner is required for the investigation but is

not cooperating, they will be at liberty to approach this Court for passing appropriate orders.

The petition stands disposed of.
