R.P. Nagrath, J. (Oral) Prayer in the instant petition is made under Section 482 Cr.P.C. for issuance of direction to respondents no. 1 to 4 to constitute a Special Investigating Team or hand over the investigation of FIR No. 52 dated 28.06.2012, Police Station Lambra, Jalandhar to some other investigating agency. Further direction is sought to respondents no. 1 to 4 to protect the life and liberty of the petitioners as respondent no. 6 is not allowing the petitioners to stay in the village.
Learned State counsel has filed the status report by way of affidavit of Senior Superintendent of Police, Hoshiarpur and the same be taken on record.
Learned State counsel submits that as per reply a special investigating team headed by Superintendent of Police (Investigation) has been constituted.
There is no clue of the girl so far. FIR was registered in the year 2012.
In the circumstances, therefore, investigation of the JITENDER KUMAR 2015.07.22 16:48 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-31599 of 2012 -2aforesaid FIR is transferred to the Crime Branch of the State Police. Director General of Police, Punjab be directed to constitute a Special Investigating Team to investigate the above FIR, which would be headed by an officer not less than the rank of Inspector General of Police. The investigating team be constituted within a period of 15 days from the date of receipt of certified copy of this order.
With the aforesaid observations and directions, the instant petition is disposed of. In case of any grievance, petitioners would be at liberty to move appropriate petition, if need be, after six months.
