With the assistance of learned State counsel, I have gone through the role attributed to the petitioner. No specific injury has been attributed to the petitioner. He has joined the investigation. The culpability of the petitioner as a member of an unlawful assembly, would certainly be a debatable issue during trial. It does not appear to be a case of custodial interrogation.
The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
