The present appeal pertains to the year 1997. Vide order dated 12.12.2023 notice was issued to the appellant as none was appearing on his behalf. As per the Office report, the sole appellant remains unserved due to incomplete address. There is no other address of the appellant available with the Court for effecting his service except the one mentioned in the memo of parties and in the judgments and decrees passed by both the Courts concerned and is the same on which the notice was sent.

Learned counsel appearing on behalf of the appellant today states that he has no instructions in the matter.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
