Through this petition under Section 439 Cr.P.C., petitionerSurender @ Sinder, has prayed for grant of regular bail in case FIR No. 485 dated 25.11.2018 registered under Sections 148, 149, 302, 307, 323, 427, 452 and 506 IPC and Section 25 of the Arms Act at Police Station Kurukshetra University, Kurukshetra.
Learned counsel inter alia contends that petitioner was not named in the FIR, nor any injury has been attributed to him. Three star witnesses of prosecution, namely; PW-1-Satish Kumar, PW-2 Hem Lata and PW-3 Sagar have turned hostile. Petitioner is in custody since 04.07.2019. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. More so, co-accused of RISHU KATARIA 2020.06.29 14:50 I attest to the accuracy and integrity of this document
CRM-M-14801-2020 -2petitioner, namely; Rahul Malik and Gulshan , have already been granted the concession of bail by this Court vide ofder dated 12.02.2020 (Annexure P-3) passed in CRM-M-5209-2020. Thus, treating the case of petitioner on the same parity, he may also be released on regular bail. On the other hand, learned State counsel has not seriously opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Surender @ Sinder, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
