Through this petition under Section 439 Cr.P.C., petitionerJasbir Singh, has prayed for grant of regular bail in case FIR No. 508 dated 09.09.2016 registered under Sections 148, 149, 302, 307 and 323 IPC and Section 25 of the Arms Act at Police Station Thanesar Sadar. According to prosecution, on 09.09.2016, a free fight took place in between two groups, being supporters of rival candidates in BPSO Elections. Both the sides caused multiple grievous injuries to each other. Indiscriminate firing was also done from both the sides. One Hardeep Singh, from the complainant party died in the incident. CRM-M-14803-2020 -2falsely been implicated in the instant case. The petitioner is in custody since 29.12.2019. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. More so, main accused, namely; Vishal, Ankush, Manish, Munish @ Manu, Sachin @ Chinu, Gurjit Singh @ Goldy and Sahil, have already been granted the concession of bail by the learned Additional Sessions Judge, Kurukshetra, vide orders dated 07.03.2017. 09.03.2017, 16.03.2017, 17.03.2017 and 22.03.2017, respectively. Thus, treating the case of petitioner on the same parity, he may also be released on regular bail. Learned State counsel has not opposed the above submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Jasbir Singh, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
