The petitioner seeks the concession of bail pending trial in FIR No.123 dated 10.07.2017 under Sections 406/498A/328/120B IPC, registered at Police Station City Gurdaspur.
It is submitted that the matter has been amicably resolved between the parties before the Mediation and Conciliation Centre of this Court on 17.11.2017. Settlement/agreement dated 17.11.2017 arrived at between the parties is attached with this file. The son of the petitioner and his wife i.e., the complainant's daughter have decided to file a petition under Section 13B of the Hindu Marriage Act, 1955. CRM No.M-27757 of 2017 -2abide by the terms and conditions of the settlement. The petitioner was released on interim bail vide order dated 19.11.2017 passed by this Court and he has not misused the concession in any manner. Therefore, it is prayed that this petition be allowed.
Learned counsel for the complainant verifies the factum of settlement between the parties and submits that his client has no objection in case this petition is allowed, subject to strict adherence to the terms and conditions of the settlement.
There are no allegations on behalf of the State that the petitioner is likely to abscond, if released on bail.
Keeping in view the facts and circumstances of the case, specifically the settlement arrived at between the parties, but without commenting upon or expressing any opinion on the merits thereof, it is considered just and expedient to allow this petition. Consequently, interim bail afforded to the petitioner by this Court vide order dated 19.11.2017 is made absolute subject to his furnishing fresh bail bonds and surety to the satisfaction of the learned trial court and shall enure during the pendency of the trial.
