Through this petition under Section 439 Cr.P.C., petitionersAshwani @ Pinda and Krishan @ Bhandi, have prayed for grant of regular bail in FIR No. 47 dated 21.01.2018 (Annexure P-1) registered under Sections 324, 341 and 506 read with Section 34 IPC (Section 326 IPC has been added later, after deleting Section 307 IPC) at Police Station Samalkha, District Panipat.

According to the prosecution, in the wee hours of 20.01.2018, the petitioners have caused 14 injuries to Sandeep-injured with Scissors. 3.

Learned counsel inter alia contends that the petitioners are in custody since 21.01.2018. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioners in jail. 4.

On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioners and submits that 11 injuries, out of the said 14 injuries were declared grievous in nature. CRM-M-28703-2018 -2police is now filing supplementary challan against the petitioners under Section 326 IPC.

I have given anxious consideration to the submissions made by learned counsel for the parties.

Considering the overall circumstances of the case, without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed. Both the petitioners, namely; Ashwani @ Pinda and Krishan @ Bhandi are ordered to be released on regular bail pending trial, subject to their furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
