******* SURINDER GUPTA, J.(Oral) This is petition challenging order dated 27.07.2017, whereby application filed by petitioner seeking permission to visit Germany and Poland was declined by Special Judge, CBI Court, Chandigarh on the ground that case is at the stage of framing of charge and presence of petitioner is required.

Learned counsel for the petitioner submits that the next date fixed in this case is 18.08.2017 and the petitioner will return on 13.08.2017 and will be present before the trial Court on 18.08.2017. He further submits that the petitioner has been allowed visa only for seven days to visit these two countries. Earlier also the petitioner was permitted to go abroad and he had not misused the concession and returned in time. Learned counsel appearing for CBI submits that the petitioner, if permitted to go abroad, may not return, as such, he may be directed to furnish heavy surety in the shape of bank guarantee. CRM-M-27783 of 2017 -2misused the concession allowed to him and undertaking by learned counsel for the petitioner that the petitioner will return by 13.08.2017 and will be present before the trial Court on 18.08.2017, the date already fixed before the trial Court, I find no reason to decline permission to petitioner to go abroad. He is allowed to go to Germany and Poland during the period from 06.08.2017 to 15.08.2017 on his furnishing bail bonds and surety bonds in the sum of `25 lacs to the satisfaction of trial Court. Disposed of in above terms.
