": for grant of regular bail in FIR No.268 dated 07.08.2024 under Sections 137 and 96 of Bharatiya Nyaya Sanhita, 2023 (corresponding Section 363 and 366 (a) of IPC, respectively) (Section 64 (2), 318 (4) of Bharatiya Nyaya Sanhita, 2023 (corresponding Section 376 and 420 of IPC) and 6 of POCSO Act, added later-on), registered at Police Station Civil Lines, District Jind.

As per facts of the case, complainant 'SK' gave his statement


that his daughter i.e. victim 'S' aged about 17 years 10 months, whose date of birth is 04.10.2006, after passing her 12th class, was preparing for NEET in Akash Institute, Jind. She was staying with her Massi for the last about 2 months. On 07.08.2024, he received a call from his sister-in-law that his daughter 'S' left the house at about 12 o'clock noon without informing anyone. Complainant along with his relatives inquired and came to know that Nitin Sheokand was wandering around his daughter and sometimes they used to talk on phone. On inquiry, he found that his daughter has been kidnapped with bad intention by giving some allurement by Nitin Sheokand. With these allegations, present FIR has been registered.
During investigation, victim was recovered on 22.08.2024. On 23.08.2024, her statement was recorded under Section 183 3$4

I have considered the arguments and have gone through the record. Regular bail filed by the petitioner was declined by learned Additional Sessions Judge, Jind vide order dated 20.02.2025 (Annexure P2). Present petitioner is 22 years old. Whereas victim was 17 plus at the time of said occurrence. It cannot be ignored that she was minor. She left the house on 07.08.2024 and was recovered on 22.08.2024. Petitioner was also arrested on 24.08.2024 and since then he is behind the bars. Challan is presented. Trial is under progress. Statement of the victim is also recorded. Therefore, petitioner in case, released on bail will not be able to influence the victim. Till date, four prosecution witnesses have been examined. Statement of victim, her uncle and parents are annexed as Annexure A-1 to A-4. Since other witnesses are yet to be examined, therefore, trial may take
