ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 16.01.2023, when both learned counsels for parties stated that being an old matter, they do not have instructions from their clients and Registry was asked to issue notice to parties. Needful has been done.

Office report reveals that appellant No.3 as well as sole respondent have died. However, none appears for appellants No.1 and 2 despite service.

It appears that by sheer effluxion of time, since appeal has been pending for the past almost 26 years, appellants have lost interest to pursue the appeal, neither the appellants nor legal heirs of appellant No.3 have taken any steps to contact their counsel, despite service. In the premise, instant appeal is dismissed for nonprosecution with liberty to file application in case appellants/legal heirs wish to do so at later stage.
