(Oral) Quashing of FIR No. 215 dated 22.12.2010 under Sections 452/447/511/427/148/149 IPC, registered at P.S. Sadar, Ludhiana, is being sought on the basis of compromise dated 06.08.2014 (Annexure P-2) and affidavit dated 07.08.2014 (P-3).
F.I.R has been registered on the statement of respondent No. 2 against the petitioners with the allegations that the son of the complainant Jatinder Kumar had purchased one plot measuring 150 Sq yards at Ludhiana and on 21.12.2010, his daughter Geeta Bawa telephonically conveyed that 8-10 persons are trying to take possession of the house.
The matter has now been duly compromised, vide compromise dated 06.08.2014 (Annexure P-2) and affidavit dated 07.08.2014 (P-3).
In compliance of order dated 09.12.2014, report of District and Sessions Judge, Ludhiana has been received in this regard. As per GAURAV 2015.01.15 15:39 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-27858 of 2014 (O&M) -2report, statement of complainant-Malkiat Dass has been recorded to the effect that he had compromised the matter with the accused persons and have no grudge against them. He has no objection, if the present F.I.R be quashed against the petitioners. Statements of petitionersSurinder Saggu, Roxy Saggu,Gurdeep Singh, Gurmeet Singh, Sukhbir Singh, Jagjit Singh Sandeep Singh, Jaswinder Singh, Kulwinder Singh, Raghbir and Munish have been recorded to the same effect. The compromise has been entered voluntarily and without any pressure. Consequently, in view of the status report and in view of the judgment of the Hon'ble Supreme Court in the case of Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429, the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs.
State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging the litigation. Accordingly, FIR No. 215 dated 22.12.2010 under Sections 452/447/511/427/148/149 IPC, registered at P.S. Sadar, Ludhiana, is quashed with all consequential proceedings arising therefrom. The petition stands disposed of.
