******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.258 dated 24.06.2018 registered for the offence punishable under Section 61 of the Excise Act, at Police Station City Barnala, District Barnala.

Heard.

Learned State counsel submits that the petitioner has joined the investigation. The vehicle, from which liquor was recovered, was owned by him as per affidavit of previous owner.

As per case of prosecution, 10 cartons of liquor 'Cash Malta' were recovered from Swift car bearing no. HR-33C-6742. The occupants of the car including its driver succeeded in running away from the spot. Keeping in view the fact that recovery of liquor has already been effected and custodial interrogation of the petitioner is no more JITENDER KUMAR 2018.09.26 15:05 I attest to the accuracy and integrity of this document Chandigarh required for the purpose of further investigation of the case, this petition is

CRM-M-28766 of 2018 -2allowed and order dated 12.07.2018 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
