The present petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) read with Section 528 of BNSS, 2023 seeking interim regular bail to the petitioner in case bearing FIR No.14 dated 15.01.2026 (Annexure P-1) under Sections 331(4), 305 of BNS (subsequently added Sections 310(2), 317(2), 61(2) of BNS) (erstwhile Sections 457, 380, 395, 411, 120-B IPC) registered at Police Station Canal Colony Bathinda, District Bathinda for a period of 08 weeks on account of his own marriage which is scheduled to be held on 21.03.2026.

Learned counsel for the petitioner contended that the marriage of the petitioner is scheduled to be solemnized on 21.03.2026; the petitioner has

CRM-M-13396-2026 -2not been named in the FIR and has been nominated in this case on the basis of a disclosure statement of co-accused namely Anil @ Aampuri as per which the role attributed to the petitioner is that he purchased stolen silver from him; the petitioner was arrested on 08.02.2026 and is behind bars since then; he is having clean & clear antecedents and is not involved in any other criminal activity; earlier his marriage was scheduled to be held on 11.03.2026 but his application for interim bail was rejected by the Court of learned Additional Sessions Judge, Bathinda vide order dated 05.03.2026 and now the marriage is rescheduled to be solemnized on 21.03.2026 and the hence, prayed for interim regular bail.

On advance notice, Mr. Anup Singh, AAG, Punjab, accepts notice on behalf of respondent-State and by way of filing of custody certificate dated 12.03.2026, does not controvert to the fact that the marriage of present petitioner is scheduled for 21.03.2026 and apprised the Court that the matter is still under investigation. He fairly admits that the petitioner is having clean & clear antecedents and is not involved in any other case. 5.

Heard and paper book perused.

Keeping in view the facts and circumstances of the present case and contentions raised by learned counsel for the parties and the fact that the allegations against the present petitioner that he received property which belonged to commission of dacoity; he is in custody since 08.02.2026; the marriage of the petitioner is scheduled to be solemnized on 21.03.2026 and the same has been verified by the State, hence, this Court finds merit in the present

CRM-M-13396-2026 -3petition and the present petitioner is directed to be released on regular interim bail on 18.03.2026 at 10.00 A.M. for a period of 03 weeks, on his furnishing requisite bonds to the satisfaction of the Illaqa Magistrate/Duty Magistrate/Chief Judicial Magistrate concerned while imposing such conditions so as to secure the presence of the petitioner to join the investigation as and when required to do so. The petitioner is directed to surrender before the Illaqa Magistrate concerned on 09.04.2026.
