Learned counsel for the respondent states that the present appeal has since been rendered infructuous inasmuch as the property in dispute is in possession of the legal representative of the plaintiff-respondent and the parties have since died.

On the last date of hearing i.e. 02.04.2024, learned counsel for the appellant had stated no instructions in the matter and notice was issued to the appellant. As per the office report, son of the appellant has duly received the copy of the notice. However, no one has put in appearance. 3.
Dismissed as having been rendered infructuous with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
