Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.48 dated 28.5.2014 under Section 22 of the NDPS Act, registered at Police Station Lambra, District Jalandhar.

Notice of motion.

Ms.Simsi Dhir Malhotra, Deputy Advocate General, Punjab, who is present in the Court, accepts notice on behalf of respondent-State and contests the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the case of the petitioner, he was on regular bail and appearing before the Court. The charge has already been framed against him. The recovery from the petitioner was non-commercial. CRM No.M-27800 of 2015 -2He absented from the proceedings on 21.04.2015 and his personal bond and surety bonds have been forfeited to the State and nonbailable warrants have been issued against him for 08.07.2015. The reason given for the absence of the petitioner is that he mistook the date.

Keeping in view the facts and circumstances of the present case that the petitioner absented from the proceedings because he mistook the date as argued, no useful purpose will be served by sending him or keeping in custody till the disposal of the case, which will take long time.

In view of the above discussion, I find merit in the present petition and the same is allowed. The petitioner is directed to appear before the trial Court within seven days from today and on doing so, he shall be released on bail by the trial Court to its satisfaction.
