Daya Chaudhary, J. (Oral) The present petition has been filed under Section 439 Cr.P.C. on behalf of the petitioner-Rajbir for grant of regular bail in case FIR No.56 dated 23.04.2015, under Section 306 read with Section 34 of Indian Penal Code registered at Police Station GRP Rewari.
Learned counsel for the petitioner submits that there is delay of 15 days in lodging of the FIR. Even in the suicide note, the petitioner was not named and he has been shown to be related to Chander Pal. Learned counsel further submits that out of total 24 prosecution witnesses, 4 have been examined so far and the trial will NEETU RANI 2015.08.28 17:22 I attest to the accuracy and authenticity of this document Chandigarh
Criminal Misc. No. M-27804 of 2015 (O&M) take long time in conclusion. Learned counsel also submits that the co-accused of the petitioner, namely, Ravi, has already been released on regular bail on 11.08.2015. The petitioner is in custody for the last more than 31⁄2 months.
Learned State counsel has not disputed the custody period but opposes grant of bail to the petitioner.
