(ORAL) Prayer in the instant petition under Section 438 Cr.P.C., has been made for grant of pre-arrest bail to petitioner Amarjit Singh @ Babba in case FIR No.30 dated 04.03.2017 under Section 61 of the Excise Act, registered at Police Station Kathu Nangal, District Amritsar Rural. On secret information that petitioner was indulging in making illicit liquor and selling the same from his house, a raid was conducted and 90 kgs of lahan along with 20 bottles of whisky and one working still was recovered from his house.

Learned counsel for the petitioner contends that petitioner was not apprehended at the spot. The entire prosecution story is false because it was impossible for the petitioner to escape from the spot in the presence of huge number of police officials. This is the first false case in which the petitioner has been booked, as no other criminal case is pending against the petitioner.

-2CRM-M-27852 of 2017 the fact that 90 kgs of lahan along with 20 bottles of whisky and one working still was recovered from the house of the petitioner, which was not possible for the police to procure by spending money from its own pocket to falsely implicate the petitioner, the custodial interrogation of the petitioner is necessary.
