**** HARNARESH SINGH GILL , J. (ORAL) Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 107 dated 07.8.2019 under Sections 376, 376-D IPC (Section 376-D IPC added later on) registered at Police Station Mukerian, District Hoshiarpur. Learned counsel for the petitioner submits that there is a delay of 74 days in lodging the present FIR and the petitioner has been in custody since 23.8.2019. He further submits that prosecutrix is a married lady of 27 years and having two children and she has herself given a statement before the police that she left the house on her own on 21.5.2019 and it was at the later stage the FIR in question was got registered. The bail application has been opposed by the learned State counsel.

CRM-M No. 14831 of 2020 -2In the present case, there are specific allegations against the petitioner that the prosecutrix went along with him to Mukerian where she was served juice by him and thereafter she lost her senses and taking advantage of that, the petitioner along with other co-accused took her to some isolated place where petitioner committed rape upon her. The allegations against the petitioner are serious in nature. The prosecutrix is still to be examined in the present case.
No case for grant of regular bail to the petitioner is made out. The petition is dismissed.
