The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.85 dated 27.3.2018 registered for the offence under Section 379 IPC at Police Station City Rajpura, District Patiala.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The present petitioner is named in the FIR by the complainant Harpal Singh Parmar 2018.08.01 10:19 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-28795 of 2018 [2] on the basis of his personal enquiry. The allegations in the FIR are that the motorcycle of the complainant, which was lying parked outside his house, was stolen. The motorcycle is stated to have been recovered from the coaccused. The learned State counsel argued that there are other cases also against the present petitioner and they have formed a gang, therefore, the petitioner is required for custodial interrogation. Keeping in view the facts and circumstances of the case and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
